EU imposes anti-duties on Chinese tiles for another 5 Years

According to the report of EL MUNDO, on 24th November, the Spanish Ceramic Tile Manufacturers' Association and the European Ceramic Tiles Manufacturers Federation held a press conference and announced that Chinese tiles imported to Spain and the European will be levied the duty ranging from 13.9 % to 69.7 %.

Actually, on 23th November, the official Journal of the European Union has released a document to announce that the European Union will impose a definitive anti-dumping duty on imports of ceramic tiles originating in China following an expiry review. In other words, The European Union has extended duties on Chinese tiles for another 5 years to November 2022, maintaining the levels that had been in force since 2011 when it has already imposed anti-dumping duties ranging from 30.6% to 69.7%.

It has been revealed that the investigation lasted more than a year. During the investigation, the European Commission has analyzed whether there was a likelihood of continuation of dumping should the measures be allowed to lapse. So, it looked into the Chinese production capacity and spare capacity, the behaviour of Chinese exporters on other markets, the situation on the domestic market of China and the attractiveness of the Union market.

It found that China’s production capacities has continued to exceed the Union's production capacity by far, and China’s sales prices to the rest of the world further decreased after review investigation period(from 1th July 2015 to 30th June 2016). Meanwhile, Chinese producers are likely to try to increase their sales using their available capacities to the Union if the measures were allowed to lapse. Thus, it concluded that there was a necessity to maintain the previous measures.


However, it is worth noted that, during the investigation, the Chinese Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters (the ‘CCCMC’) has contested the methodology of analogue country for establishment of the normal value as such, arguing that Section 15 of the Protocol of Accession of China to the WTO had lapsed after 11th December 2016. Therefore, the normal value for the Chinese exporting producers should be calculated on the basis of their own domestic prices and/or costs. However, the European Union has refused CCCMC’s legitimate claims and continued to used USA as analogue country for the purposes of establishing the normal value with regard to China.


It has been revealed that since anti-dumping duties have been introduced in 2011, Chinese tiles imports to Europe have dropped by 77%, declining from more than 66 million㎡ to nearly 16 million㎡. Anyway, just like Henry.Ford once said, when everything seems to be going against you, remember that the airplane takes off against the wind, not with it. Chinese companies can keep on strengthening their power by improving product quality and designs.
